This SMS Privacy Policy (“Policy”) describes how Darkblue, LLC, a Massachusetts limited liability company (“Darkblue,” “we,” “us,” or “our”), collects, uses, stores, and discloses information in connection with its text messaging (“SMS”) services.

This Policy applies solely to SMS-related data and is independent of any general privacy policy that may otherwise apply to Darkblue’s products or services.

1. Scope of the SMS Service

Darkblue’s SMS services are used exclusively to support operational communications for an online medical control phone system for Emergency Medical Services (“EMS”). SMS messages are non-promotional, one-way, and limited to system-related notifications.

The SMS service is available only to authorized users who have affirmatively opted in and is intended for use within the United States.

2. Information Collected

In connection with the SMS service, Darkblue may collect and store the following information:

• Mobile phone number
• User or account identifier
• Consent and opt-in timestamp
• Message metadata (such as send time)
• Delivery status (e.g., sent, failed)

Darkblue does not store SMS message content beyond what is necessary for message delivery and does not associate SMS records with call audio, medical information, or protected health information.

• Operating and supporting the EMS phone system
• Ensuring system functionality, reliability, and availability
• Maintaining audit and consent records
• Complying with applicable legal, regulatory, and carrier requirements
• Internal troubleshooting and operational support

SMS-related information is not used for marketing, advertising, or behavioral analytics, and is not sold or licensed to third parties.

4. Disclosure of SMS Information

Darkblue may disclose SMS-related information in the following limited circumstances:

• To telecommunications carriers and SMS infrastructure providers as required to deliver messages
• To service providers involved in hosting or operating the SMS infrastructure
• To the organization that engaged Darkblue to develop and manage the EMS phone system, provided such information is anonymized and cannot reasonably be used to identify an individual
• To law enforcement or governmental authorities when required to do so by law, regulation, or legal process

Darkblue does not share SMS-related information with advertisers, data brokers, or other third parties for their independent use.

5. Data Retention

SMS-related information is retained on an indefinite basis for operational, auditing, and compliance purposes, unless and until it is no longer required or is removed as part of system maintenance or decommissioning.

6. Data Security

Darkblue maintains reasonable administrative and technical measures designed to protect SMS-related information against unauthorized access, disclosure, alteration, or destruction.

No method of transmission or storage is completely secure, and Darkblue does not guarantee absolute security of SMS-related information.

7. Individual Rights

SMS-related information is collected and maintained for operational purposes. No individual access, correction, or deletion rights are provided with respect to SMS-related data, except as required by applicable law.

8. Changes to This Policy

Darkblue may update this SMS Privacy Policy from time to time to reflect changes in operations, technology, or legal requirements. Updates will be effective upon posting or other reasonable notice.
